Principle of Retribution for International Crimes Essay

Principle of Retribution for International Crimes - Essay Exampleh. With off a coherent philosophical theory of criminal punishment to beg off international criminal arbiter, the mere authority or permission to apply a set of norms to international criminals remains vacuous. If such trials cannot provide substantive justice in a philosophically meaningful sense, they are more deeply flawed than any procedural objection would reveal. (John, 2001)The idea that all criminals should be penalise for their illicit deeds, regardless of their political position, is at the heart of the modern international criminal law regime. The former argues that the benefits, over either the short or grand run, of punishing people such as Goring or Saddam Hussein in a legal forum justify such trials. such thinkers point to the usual battery of utilitarian arguments for punishment deterring future crimes, establishing a historical record of the criminal acts, reforming lawbreakers, providing a sense o f closure to their victims, and so aside The otherwise, more abstract view declares that justice itself demands that these people be punished independent of any harmful or beneficial consequences that may arise from their trial. For retributivists, other benefits of punishment, though desirable in themselves, are morally insignificant. It is the latter view that is the only valid justification for trying the unique sorts of crimes that the international courts have been designed to handle. (Larry, 2005)Arnaud does not argue for the philosophical soundness of retributivism as such, nor he defendes the philosophical legitimacy of war-crimes trials in general. Specifically, he stated that one cannot make sense out of the intuitions, values, and beliefs that stand behind the current movement toward international criminal trials and war-crimes trials (or their shared ideology, if you will (Arnaud 2004, 1) unless one understands it to be rooted in a retributivist theory of punishment. slice the term ideology is a loaded one, it nonetheless captures the point the ideology standing behind modern international criminal law and the laws of war displays a noted bias in favor of the retributivist principles articulated by Kant (among others). Ultimately, war-crimes trials do not provide the greatest happiness for the greatest number. (Christopher 2002, 43-61)Despite some crucial philosophical differences among individual thinkers, retributivists share some common central beliefs. For these thinkers, the rationale for punishment is metaphysical in character in the sense that it is rooted in abstract principles of justice and right. Justice is the independent, nonmaterial motivation for punishment, and it serves as the sole determining ground for punishment. Lunch is really important for us to have a recharge of energy and just take a break (Luckerson, 2012).The bring in of Wal-Marts management that women are not interested in managerial positions is completely false. Women have the same goals and desires as men of moving up the corporeal ladder. Unfortunately at Wal-Mart its corporate culture suffers from the glass ceiling effect. The popular notion of glass ceiling effects implies that gender disadvantages are stronger at the overhaul of the hierarchy than at lower levels and that these disadvantages become worse later in a persons career (Cotter, Hermsen, Ovadia, Vanneman, 2001). Women at Wal-Mart are viewed as second class citizens that do not have the same opportunity for career growth as men. Women were systematically discriminated by Wal-Mart. The company has not been able to truly take advantage of the virtues of diversity because of its discriminating stance against women. The position of Wal-Mart of not offering wellness care reporting up to par with the benefits other employees receive in the industry can be considered an ethical issue due to the fact that Wal-Mart is not attending the health needs of its workers. As a result, there wages can easily be wholeocated to this order because we deal that they have worked on this particular order during the week we can easily apportion this to the order and since it is the line of accountants to allocate all the recognizable be to the enamour cost centers, this order is the cost center and the cost activity of the workers is rightly apportioned to this order. The extra cash lost Accountants are only concerned with the pellucid costs and they are least concerned with the implicit cost. Implicit costs are the opportunity cost like this one. These are not the real costs but are based on economic assumption of the next best alternative. As a result, when preparing the job order cost statement, I have not included the implicit tot as it is of undersize value to the accountants. Machinery depreciation Machinery depreciation is a fixed cost. It means that irrespective of the operations performed by the machinery, a depreciation charge will be levied. much(prenominal) costs do not vary with the output or the operations performed and hence we call them the fixed costs. In this case, since we have made a divert adjustment of the fixed overheads, it will lead to double addition i f we add this cost separately. In more professional terms, these will windows get along the financial statement and hence will give a different picture to the cost statement than it is in reality. For the reasons given above, I have excluded the amount for machinery depreciation from the cost statement. Electricity The statement in the question tells us whether the order is received or not, the machinery will be in continuous use. Semiotic is a discipline, which can provide a unified framework for Essay

Semiotic is a discipline, which can provide a unified framework for conducting the different processivities within in frameation syste - Essay sampleThese elements will provide the basis of the discussion on how the unified frameworks along with other capabilities will help organisations solve the challenges entailed in designing, building and maintaining information systems. The call for for Meaning Henry Stubbes was credited to have first coined the term semeiotics when he identified it as a branch of medical science that interpret signs (Bhaduri, 2008, pp.246). illusion Locke also referred to the terms semeiotike and semeiotics when he explained his notion about the branches of science. He stated All that can fall within the compass of human understanding, being either, first, the record of things, as they ar in themselves, their relations, and their manner of operation or, secondly, that which man himself ought to do, as a rational and voluntary agent, for the attainment of any end, especially happiness or, thirdly, the slipway and means whereby the knowledge of both the one and the other of these is attained and communicated I think science may be divided properly into these three sorts (Locke, 1823, pp.174). It was Lockes third branch, where he mentioned semiotics as one of those secern of exact knowledge. The work of Charles perforate and later on Ferdinand de Saussure, however, established the modern notion of the discipline. Pierce referred to the concept of semiotic as a quasi-necessary or formal doctrine of signs. His position on signs is based on his three classifications of its dimensions icons, indices and symbols (Rahmann, 2001, pp.4). Saussure contributed to the semiotic impression through his discourse of his version of semiotics, which he called as semiology. In 1915, he declared that A science that studies the life of signs within society is conceivable it would be a part of social psychology and consequently of general psychology I shall call it Semiology. Semiology would show what constitutes signs, what laws govern them Linguistics is only a part of the general science of semiology the laws discovered by semiology will be applicable to linguistics (cited in Rahmann, pp.3) Today, adherents of semiotics consider, interpret, classify and analyze signs according to the manner of transmission. The computer code is a crucial variable in this process because it is the means by which meaning is understood. A new word, for example could easily be coined. Saussure did this with his semiology term. The act alone did not ensure that meaning is transmitted. First, the word must be recognized by the society. Then, it must be transmitted according to the grammatical structures and codes of such society. This is the general framework that underpins semiotics. In the present language, semiology is semiotics. Let us consider the case of a poem. It is an example of a semiotic system because it is consisted of signs in the f orm of content or rhythm, wherein each constitute a term and a concept not unlike the sensation that one will experience with the aesthetics of the figure of speech. One can also cite the case of a song. Say, in Kenny Loggins song Footloose the lyrics is the message, the score becomes a text and the device where these are communicated could be a digital music player. These examples show how semiotic systems are considered the organisation of patterns that typify signs, which

Mind-Body Problem Essay Example | Topics and Well Written Essays - 750 words - 2

Mind-Body Problem - Essay ExampleThe five theories include behaviorism, dualism, reductionism, functionalism, and eliminative materialism and each of them has its own tenet in explaining the behavior of a psyche in a trusted context (Turner 4-6). According to dualism perspective of looking at human life, there are antithetical sides of life that conflict or complement each other in the process of an individual acting in a context. For example, according to the theory, one psyche behaves in a certain way because of the moral dualism that exists between the people and which explains that there are two sides of morality. This means that a persons actions keister be either towards morality or against it, which is shaped by the various ways of defining morality from different contexts and societies or societal description of it (Turner 39-41). behaviouristic psychology is a theory that explains the actions of an individual from the context of the past behavioral actions to predict b ecause the theory argues on the bases of human experience in society. This theory argues that what is manifested physically by a person can be used to explain the differences that are in the chief of the individual and people can use clear digest of behaviors to give explanations that are relevant to predicting their behavior. This means that according to behaviorists, the behavior of a person is consistent according to the things they do or the things they engage themselves and if a person can be able to identify the trends of behavior of another, he or she can be able to predict the way the first person willing respond to a situation (Turner 76). According to the functionalist theory, the mental constructs exist because of its function it serves and without such, it cannot be important to the individual who has them. This means the beliefs, desires, and pain exist in the mind of a person because that person needs them to perform an action in the context he or she finds himself or herself. This implies that according to functionalist, mental constructs are ward off and irrelevant if they do not exist to serve any purpose in the person who has them whether they are perceivable to be good or deleterious (Turner 78). According to the perspective of the reductionist, a system that is complicated and has many constituents has an influence on the small constituents and they can be used to explain the constituent. According to these theorists, for example, in a society, the general culture shapes the behavior of individuals and these individuals can be used to explain the reasons wherefore culture is the way it is. This means that the individuals in a certain context are dependent on the general context of behavior and therefore, one of them in that context can be used to explain why the groups behave the way it does (Turner 93-94). The theory of eliminative materialism argues that there are no neural bases that can be used to explain various contexts of desir e or beliefs of a person since they have poor definitions.

Teen Suicide Essay Example for Free

Teen Suicide EssayRomeo and Juliet is one of the most famous love invoice in the English literary tradition by Shakespe atomic number 18. The play focuses on teenagers committing suicide when they are overwhelmed they cant manipulate solutions to problems or the whole truth or what the future might be. In Romeo and Juliet, suicide is considered a solution and a misunderstanding. Not in all cases is this necessarily true , there are many reasons for someone to commit suicide. In the course of the play, the young lovers are driven to kill themselves for one another in order to be together. ( Juliet pretends to kill her egotism so that she could be with the one she loves. ) When there was a misunderstanding and Romeo thought she was dead he then killed him self) They decided to commit suicide because they did not see the whole truth of what the future might be. Teen suicide is the superseding theme of the play which is represented by hatred, unleashed emotions in which leads them do the unexplainable against others and even to them selves. In 1995 Christian, 14 and Maryling,13 were lovers who were not allowed to see one another against their will.Later on they stood at the edge of a Florida canal, joined hands and jumped 15 feet into the cold wet to their death. They believed that was the only way they could be truly together. This is exactly what happened in the play Romeo and Juliet. As in the Play Romeo an Juliet even though it was a misunderstanding they wouldnt go on with their live and forget the other you die, we die together. The nature of suicide can be seen in the way it was described in Romeo and Juliet. At clock through out the play it was described as parents not understanding and others as a simple misunderstanding. Kids have so much to deal with and are always put on the spot. Many teens experience stress weather its from school or home. Especially with school, having to deal with other peers as well as functional hard is not quite easy. H aving to always worry about your future, parents always up your case on how your performance is at school. Other reasons charge up to a sense of self doubt, confusion, depression and other fears. In many cases it is considered a solution, teens feel thats the only way they could end with their miseries and live a intermission once and for all. Look at it this way the way you might be feeling now might not be the way it will be in the future. There is not a single person that could say how some ones life will end up. Trying to fix something or working on ways to improve it will make it better for the teen. Its also selfish at times to commit suicide because you leave loved ones in grieve. As in the play their families suffer from their tragic death.Romeo and Juliet does not make a specific moral statement about how suicides are wrong, It portrays that it was necessary in that case. It seemed like the author was intending for Romeo and Juliet to kill them selves because thats what wa s needed in that case. Through out this analysis, it has proved that when teenagers are overwhelmed or misunderstood teenagers seem to take the extreme by taking their lives or by attempting to. Romeo and Juliet was a perfect example in this case. It showed what drove the star crossed lovers to take their lives.

Lenovo is a well-known national defect in China and Lenovo is serving customers in to a greater extent than 160 countries. In order to expand overseas ancestry and access to world-class brand, Lenovo carried out an science of the former IBM Personal Computing Division in 2005. IBM was founded in 1911 in the United States and it is the largest information technology and stock solutions company in the world, currently has more than 30 million employees in the world, with operations in over 160 countries and regions. The chores experienced by Lenovo concerns the construction of cross- heathen ag classifys. Most of the merger and acquisition break amodal value in the post-merger cultural integration. Lenovo set up break down police squads for designing the future of IBM and developing the new view after acquisition. The results had been shown it uneasy and digest lead to the reverse of the Lenovos acquisition strategy. At the beginning of the acquisition, cultural differences had not been enough anticipated in the acquisition process. And Lenovo wants to remedy the problem as soon as possible to make IBM acquisition profitable in the next strategy. The report part of the business planSummaryThis report is intended to identify, severalize and get most solutions to Lenovo to solve the problems about teams and groups in the acquisition of the IBM. This report allow describe problems associated with team building, provides some possible solutions and evaluates distributively of these. And, this report will describe the impact of cultural differences on the establishment of spirt groups. Actually, Lenovo had taken some measures, only if it with little success. According to the current state of Lenovo, this report will cede some suggestions and solutions to overcome or avoid the contest caused by cultural differences and set up effective cross-cultural teams. Especially, these solutions are based on publications on the issue. It concludes that it is necessary for the company to establish effective and appropriate measures to eliminate the barriers in cross-cultural teams, as absence of this may threaten the companys long-term development. To overcome the problem, Lenovo should take the follow action for IBM survival * Obtain the core harbors betwixt Chinese employees and Ameri chiffonier employees through an internal survey. * approach pattern an international training program for all the employees and especially for managers. * Incorporate both corporate refinements of Lenovo and IBM to create a new corporate nicety. * Every cross- finale team should mug up monthly meeting or weekly meeting to evaluate the progress of chats and work. * Orga nise some internally non- working(a) activities to create more opportunities for the communication among employees with incompatible cultural context. * Set up the special teams to deal with the problem caused by cultural difference in every cross-cultural team.IntroductionThis section of business plan will introduce the problems caused by cultural differences in cross-cultural teams and give some suggestions to overcome the problems. In the acquisition of IBM, Lenovo doned more than 10,000 employees and it likewise means that Lenovo accepted a very divergent culture. Lenovo is not only facing the differences between western and eastern culture, but in any case Lenovo facing the problems of how to compound the teams with different organisationally cultural context. In this report, the recommendations to overcome the problems in cross-cultural teams and groups are based on the literature on team building and cross-cultural team management.BodyAt the beginning of the acquisiti on of IBM, Lenovo had taken some measures. For example, in order to both sides can communicate better, the new Lenovo use the international common land language English as the official language of the company. But cultural integration is a long-term process, which requires companies to devote their time and patience and the communication, compromise between both of high level, and staff in the acquisition. It must not be too hasty. Base on the fact of Lenovo, there are three aspects should be noticed and improved. Firstly, IBM has a long history and IBM has very high brand alertness. In addition to the brand, employees can get the respect for personal values and a comfortable working environment can be provided for employees by the human resources services and the improvement of the system. In contrast, Lenovo has a big gap no topic the position in IT industry and the strength of themselves. If some team members uphold the cultural superiority or group superiority that their own cultural value system better than those members from other cultures or groups, their behavior maybe resulting in the failure of team building because they will be possible to take nauseate and boycott from other members, even lead to conflict. Because the conflicts caused by cultural differences between team members and individual differences under thus influence, analysis and identification of cultural differences is necessary. Secondly, communication is the process of exchange and transmission of information among people or groups. Because of the multi-cultural background, language and non-language barrier, people lack of understanding of each others political, economic, legal, social and cultural environment, and the understanding of the customs, values, etc. are different. They are often based on their own perspective to make an analysis and judgment on each others information, and thus the misconceive and conflict are often obtained. Because of these, design a multi-cultural training and hold a monthly meeting or weekly meeting is necessary. Thirdly, a company has an acquisition of another company means an integration of two different corporate cultures. When the employees of a cross-cultural group are conscious of the different of personal cultural awareness with others, it will be cause the group lost their purpose. Based on the possibility, establish a common business concept and corporate culture is a good solution to this problem.Establish a new joint management concept and a strong culture based on the environmental requirements and the principle of the companys strategic development, so that reducing cultural conflict and that each employees thinking and behavior can combine with the companys operations and purpose. Adopting these recommendations and the actions in epitome can make internal and external combination of the teams more closely, establish a good reputation in the international market and enhance transnational cultural adaptability. This is the ultimate goal of why Lenovo needs solve the cross-cultural issues of teams and group in the acquisition of IBM. (1077 words)Section 21. What the literature says teams and groupsThe importance of teams and groups for an organisationIn modern society, bingle persons power, information and resources are limited. Most time people need cooperate with others no matter working or others as Handy (1993) said On average, managers spend 50% of their working day in one sort of group or other. elder managers can spend 80%. Although there is no clear and single definition of a teams and groups, there is a basic limited definition by Bennett (1991) a collection of two or more people who possess a common purpose. The formation of an organisation groups in order to compass the purpose of work more efficiently. An organisation can produce some different kinds of groups, for example formal and informal, LOCO, HICO, teams, etc. An organisation needs to be aware of their differences and u se them as efficiently as possible. There are a lot satisfying reasons why an organisation should create work groups. For example, organising effective groups can have some uses for the distribution of work, the management and control of work, problem-solving and decision-making, information processing, information and idea collection, testing and ratifying decisions, co-ordination and liaison, increased commitment and involvement, negotiation and conflict resolution, inquest or motion into the past. (Handy, 1993) No matter what kind of a group there is a bottom line is A strong group is usually more brawny than a strong individual and can have a considerable effect on organizational policy and practice.(Thomson, 2002) This literature review will make up tending on teams mainly. In a team, everyone plays different role and they have specific function and they working with an important principle voluntarily co-ordinate their work in order to achieve group objectives(Bennett, 1991 ).Building a teamPeople hope they can define their identity through their membership of sure groups like people belong to local political and pressure groups, for example, because they experience a shared set of values with the other people in the group which reinforces their own values. But, according to Thomson (1997), one reason why people belong to group is social needs. As Thomson Mabey said some groups will be family or friendship groups, which are formed to meet a diverse range of needs such as affection, security, support, belonging or identity. Some may be committees, where members usually represent different interest groups who come together to discuss their differing perspectives on matters of interest, people should build a team for the work that is highly abstruse problems, need for consensus decisions and there is uncertainty when a broad range of competences are required.A company is a big group of a lot of people working together, so the managers are responsible to build effective teams or workgroups. After collecting more individual talents, building a team has the ability to use the talents on a united effort and success is very important (Woodcock, 1979). Consequently, the managers should know how to effectively build a team. In general, the managers must have the knowledge about the five development stages (forming, storming, norming, performing and mourning) in a team or workgroup and they should have an appropriate leading regularity for themselves (Thomson Mabey, 1994). Of course, this is not enough for managing a team. The managers need realise everyones advantages and dis advantages in the team and especially the differences of their culture context.Teams and cross-cultural contextIn modern society, business environment developed quickly international. Different cultural members mixed in a team so that the team has powerful ability to solve complex problem. But, individuals from different cultural context must show a different be havior and values in the team. This is because the peoples cognition, thinking, needs, values, code of conduct, customs, etc. are formed in the years of life, work and education. The individual differences caused by cultural differences led to the conflict of the team in the cross-cultural context (Sun, 2012).So, how to make a cross-cultural team working effective is the main responsibility of managers. In a cross-cultural team, there is an important factor is a clear understanding of every one culture and values, and a process of polish. The acculturation process is a mutual exchange of cultural pattern (Olie, 1995). Related to the case of Lenovo, the best recommendation for acculturation is integration. It different with one culture dominate the others, integration is a process of acculturation (Nahavandi Malekzadeh, 1995).Interest for LenovoIn the case of Lenovo, Chinese and American must accept each other for working effectively. But the main problem in the cross-cultural grou ps is communication. The managers of Lenovo must make everyone in the group understands and adapt to the different culture with some training or actions. And more important is design a politic cooperatively cultural pattern.2. What does the literature say about different cultural contexts and its influence on teams and groupsWhat are culture and its importanceAccording to Hofstede(2003), culture is the collective programming of the mind which distinguishes the members of one group or category of people from another. It related to a group. With a large-scale research study of IBM branches around the world by Geert Hofstede, the culture is considered a compositive project. Geert Hofstede creates a new way to describe culture through five variables power distance, individualism, masculinity/femininity, uncertainty avoidance and long-term orientation. All theories have limitations. Although this method created by Geert Hofstede is not perfectly right, it does not affect the theory of Ho fstede can analyse one countrys culture as a valuable tool. Contract with the case of Lenovo, the close to important effect by culture is Currently only 25% of international mergers and acquisitions in Europe are successful. The price of failure is high. Cultural misunderstanding lead to loss of face, loss of money and, in extreme case, even loss of life (Gibson cited in Naysmith, 2006). If managers do not pay enough attention on the culture, it possibly can cause the failure of the acquisition of IBM.Organisational culture stopping point is not only exists in the countries, but also culture exists in any organisation constituted by people. Based on Handy (1993) said, The role organisation will succeed as long as it can operate in a stable environment. A steady cultural environment is necessary for an organization get success. At the same time, organisational culture is manageable and it can affects the approach of management, the accepted goals and customer of the society determin e and influence that what managers strive for and the rule observed by managers (Stewart cited in Naysmith, 2006). So, the organisation also based on the cultural context of the country. The organisational culture can also measured by the five variables created by Hofstede.(Geert Hofstede, 2001)Influence of culture on teams and groupsIf a company formed by people comes from different cultural country, this company will own a special energy. It is a competitive advantage from a cross-cultural context. But, exerting the competitive advantage effectively is the most important challenge for the cross-cultural group. Because in a cross-cultural group the members have different working purpose and processes will be revealed. (Maznevski Peterson, 1997) The effectiveness of work group will be decreased by the ethnocentrism, stereotypes, different expectations and difference in values. And these negative emotions will produce the anxiety and misunderstanding in-group, even diminishing the w orkers dedication to the company and destroying the group ardor.Interenst for LenovoCross-border mergers and acquisitions not only include the corporate cultural differences of both sides, but also include the cultural differences between the countries of the two sides. Organise some activities or cultural training to make more opportunities for every understanding different culture can eliminate the negative affects effectively.3. ConclusionThis literature review introduces some keys briefly for understanding teams and groups in a cross-cultural context. Firstly, teams and groups are limited important for an organisation. But there are some problems should be solved in a cross-cultural group. The managers is not only should know everyones cleverness and talent, but also they should know their difference caused by different cultural context. And some actions can make a good communication between each other for understanding the differences are necessary. Secondly, based on enough knowledge to understand the importance of culture, the managers should eliminate the negative affects of cross-cultural context through some activities or training. And the most important is creating an appropriate organisational culture. It can give the cross-cultural group an approach, so the cross-cultural group can exerts the competitive advantages completely.BibliographyBennett, R., (1991), Organisational Behavior, London ME/Pitman, pp.145, 154.Geert Hofstede, (2001), Cultures Consequences Comparing Values, Behaviors, Institutions, and Organizations Across Nations, Second Edition, Thousand Oaks CA Sage PublicationsGeert Hofstede, (2003), Cultures and Organisations, Intercultural Cooperation and Its Importance for Survival, Soft ware of the Mind, London Profile Books Ltd.Handy, C, (1993), Understanding Organisations (4th ed.), London Penguin, pp.150-2.Maznevski, M.
